Defending Employees From Disability Discrimination
Employers cannot discriminate in employment because someone has an actual or perceived disability. Determining exactly what a “disability” is requires knowledge of Hawaii law and current federal law that was recently changed to provide better and more protection to our disabled population.
Attorney David Simons has helped clients in Honolulu and across Hawaii with various employment and discrimination issues, including protecting employees with disabilities from discrimination and unlawful termination by their employers.
The Americans With Disabilities Act
Under the Americans with Disabilities Act, employers are prohibited from discriminating against qualified individuals with a disability when making employment decisions. Employers cannot discriminate based on disabilities when considering employees for promotions or offering benefits package. Those who violate the law can be held accountable for their actions.
If you feel you have been discriminated against (not hired or terminated) or not provided a reasonable accommodation because you are disabled please call our office.
